Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and the person or organisation operating Wheesper ("Wheesper," "we," "us," or "our"). They apply when you visit, create an account, start a discussion, follow a discussion link, or post a reply.

By using Wheesper, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.

2. What Wheesper provides

Wheesper lets a creator start a discussion with an optional opening message and an expiration choice, receive a high-entropy participant link, and share that link with participants. Signed-in discussions default to “Never.” Guest discussions do not require an email account, must expire within 30 days, and include a separate secret management link. Participants join under stable pseudonyms and can post threaded replies while the discussion is active.

The service is currently provided without charge. If paid features are introduced, we will disclose the price and any additional terms before you agree to a charge.

3. Eligibility and accounts

You must be at least 16 years old to use Wheesper. If the law where you live requires you to be older to agree to an online service, you must meet that age requirement. If you use Wheesper for an organisation, you confirm that you have authority to bind it to these Terms.

You may create a guest discussion without an email account or use an email address you control to create a recoverable creator account. Keep email sign-in links and guest management links secure. Participants use pseudonymous authentication and do not need to provide a name or email address. You may not sell, transfer, or misuse an account, authentication session, or management link.

Tell us promptly at rami@wheesper.com if you believe an account or session has been compromised.

4. Private links and anonymity

A discussion link is a bearer credential. Anyone who has it can enter the discussion, read its content, and participate while replies are enabled. Links are designed to be difficult to guess, but recipients can copy or forward them. Creators are responsible for choosing recipients and sharing links through an appropriate channel.

A guest management link is a separate bearer credential that can lock or permanently delete its discussion. Anyone who has it can use those controls. Wheesper cannot recover a lost guest management link; a guest creator can instead claim the discussion with an email account while the link is still available.

"Private by link" does not mean end-to-end encrypted, immune from disclosure, or guaranteed confidential. Wheesper and its infrastructure providers process information needed to store and deliver discussions. Participants are pseudonymous to other users, but application-level anonymity does not prevent service and network providers from processing technical identifiers.

Other participants may copy what they can see, and we cannot control information after someone records or shares it outside Wheesper. Do not use the service to store your only copy of important information.

5. Your content

"Content" means discussion titles, optional opening messages, replies, and other material you submit. You retain any rights you already have in your Content. You are responsible for it and must have the rights and permissions needed to submit and share it.

You grant Wheesper a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, display, format, and otherwise process your Content only as needed to operate, secure, maintain, and improve the service, comply with law, and enforce these Terms. This licence ends when the Content is deleted from active systems, except where a limited copy must remain in backups or be retained by law.

Your Content will be shown to anyone with the relevant discussion link. Wheesper does not claim ownership of your Content or use it for advertising.

6. Creator responsibilities

Discussion creators set the topic, choose whether the discussion expires, distribute the link, and moderate replies. If you create a discussion, you agree to:

• describe it honestly and not mislead participants about who is running it or how responses will be used;
• invite only people you may lawfully contact and protect the discussion link appropriately;
• comply with privacy, confidentiality, employment, consumer, research, and other laws that apply to your use;
• use moderation controls responsibly and avoid retaliating against good-faith participants; and
• avoid requesting sensitive information unless it is necessary, lawful, and appropriately safeguarded.

A creator's moderation choices are their own. Wheesper is not responsible for a creator's questions, decisions, promises, or use of responses.

7. Acceptable use

You may not use Wheesper to:

• break the law, facilitate illegal activity, or violate another person's rights;
• threaten, harass, stalk, exploit, or seriously harm another person;
• share child sexual abuse material, intimate imagery without consent, or sexually exploit any person;
• publish another person's private or identifying information without a lawful basis;
• impersonate someone, commit fraud, deceive participants, or conduct phishing;
• infringe intellectual property, confidentiality, privacy, or other proprietary rights;
• distribute malware, harmful code, spam, or unsolicited bulk messages;
• probe, disrupt, overload, scrape, reverse engineer, or bypass access controls, rate limits, bot protections, or security measures, except where applicable law expressly permits security research; or
• help another person do any of the above.

8. Reports and moderation

Discussion members can use the in-app Report control on a discussion or reply, select the most relevant violation category, and complete the security check. Reports are tied to the reporter's authenticated or pseudonymous session to limit duplicates and abuse. You can also report illegal content or a safety concern by emailing rami@wheesper.com. Include only the discussion link, relevant reply or pseudonym, reason for the report, and contact details reasonably needed to respond.

Authorised Wheesper administrators may review discussions and reports across the service and may proportionately restrict access, lock or delete a discussion, remove Content, preserve evidence, restrict an account, or report a matter to competent authorities. Intentionally false or deliberately misclassified reports may result in restrictions. Where required by law, we will explain a moderation decision and available ways to challenge it.

We do not promise to monitor every discussion or detect all harmful or unlawful Content. In an emergency, contact local emergency services.

9. Expiry, deletion, and termination

A signed-in discussion set to “Never” remains active until a creator or authorised administrator locks or deletes it. A guest discussion must have a scheduled expiration no more than 30 days after creation. A dated discussion's expiry makes it read-only; it does not automatically delete the discussion. Creators can delete individual discussions at any time while they retain the necessary account or management credential.

When deleting an account, a creator can delete the account and all associated discussions and replies, or delete only the account and keep every discussion and reply as a permanent anonymous read-only archive. Archived discussions retain their existing private links, do not accept new replies, and are not automatically deleted at a scheduled expiry. Removing an individual reply deletes its text but leaves a tombstone so child replies retain their place.

You may stop using Wheesper at any time. We may restrict or terminate access when reasonably necessary to address a serious or repeated violation, security risk, legal requirement, harm to users, or threat to the service. When practical and lawful, we will give notice and an opportunity to respond. Urgent risks may require immediate action.

10. Availability and intellectual property

We work to keep Wheesper reliable, but it may be interrupted, changed, or discontinued. We do not promise uninterrupted access, permanent storage, or compatibility with every device. If we discontinue the service, we will provide reasonable notice when circumstances allow.

The service, software, design, branding, and documentation are owned by Wheesper or its licensors and protected by intellectual property laws. These Terms do not transfer ownership of them to you. If you send feedback, you allow us to use it without restriction or payment.

11. Disclaimers and liability

Wheesper is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not make implied guarantees of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or that Content will remain confidential, accurate, or available.

To the extent permitted by law, Wheesper is not liable for losses that were not reasonably foreseeable when you agreed to these Terms, losses caused by events outside our reasonable control, or indirect business losses such as lost profits, revenue, opportunity, goodwill, or data.

Nothing in these Terms excludes liability where doing so would be unlawful, including liability for fraud or death or personal injury caused by negligence. Consumers retain all mandatory guarantees, protections, and remedies under the law of their country.

12. Business users

If you use Wheesper for a business or organisation, it is responsible for its use and for having an appropriate legal basis to collect information through discussions. To the extent permitted by law, the organisation will defend and indemnify Wheesper against third-party claims arising from its unlawful Content, invitations, instructions, or material breach of these Terms.

13. Disputes and general terms

Please contact us first so we can try to resolve a concern informally. Nothing prevents you from contacting a regulator, using an available alternative dispute process, or bringing a claim in a court with jurisdiction under applicable law. Consumers retain any mandatory protections and rights available under the law of their country of residence.

If a court finds part of these Terms unenforceable, the rest will continue to apply. A delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, reorganisation, sale, or transfer of the service, subject to applicable law.

14. Changes and contact

We may update these Terms to reflect service, security, or legal changes. We will change the effective date and provide reasonable advance notice of material changes when required. If you continue using Wheesper after updated Terms take effect, they will apply. If you do not agree, stop using the service and, if applicable, delete your account.
